The Non-Lucrative (or non-working) Visa in Spain (NLV) is the most commonly applied for option for Non-EU citizens from the US. Being restricted to the 90 in 180 days rule, if you are seeking a longer stay in Spain, it allows residency in Spain for a year without the ability to work, as long as you fulfill its requirements.

This can apply to various situations depending on your personal circumstances:
- If you are looking to retire to the Sun and the relaxed Spanish LifeStyle.
- If you have sufficient passive income to live in Spain without working.
- As a “stepping stone” for those looking to live here initially with a view to later applying for a different visa type, such as the Work Visa.

The initial visa is granted for 1 year, renewals then made from Spain which will be for 2 years, and again 2 years before reaching long term resident status which is renewed every five years.

Other members of the family (spouse/civil registered partner, and dependent children or parents) can also apply with you, meaning that you all become resident and move to Spain together.

The funds that you need to show for the Visa is not retained or frozen. You can freely access and use this money after the Visa has been approved.

Gain the freedom of the Schengen Area, whilst maintaining your minimum requirement of 183 days in Spain.
Spanish Nationality
If you live in USA, but you have Cuban, Puerto Rican or Latinamerican nationality, after living in Spain for 2 years (just requiring 183 days per year), you can apply for Spanish Nationality as per your rights by historical roots; much quicker than other countries that would need to live in Spain for 10 years.

WHAT DO I NEED TO APPLY FOR THE NON LUCRATIVE VISA?
The basis of the NLV will be presenting the required documents at the Spanish Consulate in the US to include:
- Sufficient funds to cover the financial means. (The amounts are based on IPREM in Spain at the time of your application. In 2024 the minimum annual amount required was set at approximately $31.200 for the applicant, and a further $7.800 for each family member thereafter)
- Criminal History record
- Medical certificate
- Sufficient Health insurance
There can be additional documents required depending on the applicant and family members, and some documents are time sensitive, requiring legalization and sworn translation.

Following your appointment our lawyer will monitor progress, and should anything additional be required, ensure that we arrange with you in a timely manner to expedite your application for Spain.
On approval, you will receive the Visa in your passport.

Second Stage – Obtaining your Residency card (TIE)
- Once you are in Spain following the visa we will arrange your registration at the local Townhall where you will be living (whether this being a property you own, or other pre-arranged accommodation)
- We will arrange the appointment at a regional Foreigners Office (Oficina de Extranjería) or National Police Station, which you will attend with prior prepared documents, and fees, and provide your fingerprints.
- On completion of these required steps, we arrange an appointment for you to collect the Residency (TIE) card, completing your Residency process.
