MORTGAGE CLAIMS IN SPAIN

If you took out a mortgage between 2000 and 2016 to purchase or renovate a property, you may be eligible to claim back amounts unfairly charged by your bank due to abusive clauses.

You can file a claim in the following situations:

  • If you still own the property and are paying the mortgage.
  • If you still own the property but have already paid off the mortgage.
  • If you sold the property and paid off the mortgage.

The banks most commonly associated with these abusive clauses are CaixaBank, BBVA, Bankia, Sabadell, Santander, Popular, and UCI/Santander Group. These are all reputable and solvent financial institutions.

3 ABUSIVE CLAUSES

There are essentially three abusive clauses through which affected consumers may be able to recover a significant amount of money:

  1. IRPH
  2. Floor Clause
  3. Mortgage Expenses

REQUIREMENTS

WHAT DO THESE TYPES OF CLAIMS INVOLVE?

The Nullity Action for these abusive clauses and claims against banks for these issues do not have statutory period, as they are considered Null and Void.

However, it is important to note that consumers have 5 years to request a refund of amounts from the initial notification-claim sent to the bank (via email, letter, burofax, etc.).

This is to say, if you contacted a bank 3 years ago to request a refund for undue payments, and they either responded negatively or ignored you, you would have only 2 years left to initiate the appropriate legal proceedings.

Nonetheless, we recommend making a claim as soon as possible due to the persistent lobbying efforts of banks to avoid their responsibilities.
