NON-LUCRATIVE VISA IN SPAIN

The ideal visa to relocate and reside in Spain for those who wish to retire or simply want to live in Spain without working.

The Non-Lucrative Visa allows non-European citizens with sufficient funds to legally reside in Spain without carrying out a professional activity, both for the principal applicant and their family.

The initial residency granted is for 1 year, after which time it can be renewed for two years, and then for a further two years.

Finally, permanent or long-term residence may be obtained after 5 years. It is important to note that these years can be counted towards the subsequent acquisition of nationality.

WHO CAN BENEFIT FROM THE NON LUCRATIVE VISA?

This can apply to various situations depending on your personal circumstances:

  • If you are looking to retire to the sun.
  • If you have sufficient passive income to live in Spain without working.
  • As a “stepping stone” for those looking to live here initially with a view to later applying for a different visa type, such as the Work Visa.
  • A year in Spain allowing you to “test the water” and see how living in Spain works for you.

The initial visa is granted for 1 year, renewals then made from Spain which will be for 2 years, and again 2 years before reaching long term resident status which is renewed every five years.

The funds that you need to show for the visa is not retained or frozen. You can freely access and use this money after the visa has been approved.

REQUIREMENTS

WHAT DO I NEED TO APPLY FOR THE NON LUCRATIVE VISA?

The basis of the NLV will be presenting the required documents at the Spanish Consulate in the UK to include:

  • Sufficient funds to cover the financial means. (The amounts are based on IPREM in Spain at the time of your application. In 2024 the minimum annual amount required was set at €28,800 for the applicant, and a further €7,200 for each family member thereafter)
  • Criminal History record
  • Medical certificate
  • Sufficient Health insurance or cover via S1 where applicable

There can be additional documents required depending on the applicant and family members, and some documents are time sensitive, requiring legalisation and sworn translation.

FIRST STAGE – Obtaining your Visa for Spain

  • Consultation to discuss your specification situation and timings.
  • Detailed checklist of the documentation you will need for the application.
  • Some documentation will require legalisation and translation - and are time sensitive – we can make these arrangements for you from our London office.
  • Completion of the Consular forms and preparation for the fee payments for your appointment.
  • Help in arranging your appointment and review of your documentation before your application is submitted.

Following your appointment our lawyer will monitor progress, and should anything additional be required, ensure that we arrange with you in a timely manner to expedite your application.

On approval, you will receive your Passport with your visa for Spain.

Second Stage – Obtaining your Residency card (TIE)

  • Once you are in Spain following the visa we will arrange your registration at the local Townhall where you will be living (whether this being a property you own, or other pre-arranged accommodation)
  • We will arrange the appointment at a regional Foreigners Office (Oficina de Extranjería) or National Police Station, which you will attend with prior prepared documents, and fees, and provide your fingerprints.
  • On completion of these required steps, we arrange an appointment for you to collect the Residency (TIE) card, completing your Residency process.
